  1. National Innovation Visa (Subclass 858)
  2. Small Business Owner Stream Visa (Subclass 491)

 

1. National Innovation Visa (Subclass 858)

This visa is specifically designed for exceptionally talented migrants, including innovative investors and entrepreneurs with cutting-edge innovations or world-class achievements.

What This Visa Offers:

  • Allows you and your immediate family to stay in Australia permanently.
  • Full rights to work and study in Australia.
  • Enrollment in Medicare, Australia’s public healthcare scheme, for your entire family.
  • A pathway to apply for Australian citizenship after 4 years, subject to meeting legal residency requirements.


Key Eligibility Criteria:

  • International Recognition: An internationally recognized record of exceptional and outstanding achievement in a profession, sport, the arts, or academia and research.
  • Australian Nominator: Must be nominated by an individual or organization with a national reputation in your field. The nominator must be an Australian citizen, a permanent resident, an eligible New Zealand citizen, or an Australian organization.

2. Small Business Owner Visa (Subclass 491)

This visa allows applicants who establish or purchase a small business and reside in a designated regional area of Australia to obtain a 491 visa for 3 years, providing a structured pathway to permanent residency and subsequent citizenship.

General Eligibility Criteria:

  • Under the age of 45 at the time of application.
  • Score at least 65 points on the Australian migration points test.
  • Demonstrate competent English language proficiency.
  • Obtain a positive Skills Assessment for your occupation.
  • Hold a valid visa with full working rights in Australia at the time the application is submitted.

State- Specific Requirements:

Currently, three Australian states participate in this program, each establishing its own specific criteria for state sponsorship:

State Business Investment & Operation Employment & Residency
Queensland Existing Business: Purchase 100% of an existing business for a minimum of $100,000 AUD. Must have operated for 2+ years prior to purchase, and you must operate it for 6 months before applying.
Start-ups: Must have operated at a profit for at least 2 years with a minimum turnover of $200,000 AUD in the 12 months prior to application.
Must employ at least one Australian citizen or resident for a minimum of 20 hours per week.
Tasmania Must have established and continuously operated a profitable business in Tasmania for at least 12 months. You must derive a personal income of at least $53,900 AUD per year from the business.
Australian Capital Territory (ACT) Must demonstrate at least 51% ownership of a registered business in the ACT, with a minimum annual turnover of $200,000 AUD. You must have lived in the ACT for at least 3 months prior to submitting your application.
