Partner /Spouse Visa

Spouses of UK citizens are able to enter the UK under this visa category and are able to work as soon as the visa is granted.

There are various requirements that need to be fulfilled by the visa applicant and the visa applicant’s spouse ( the UK citizen) in order to obtain this visa.

The requirements that need to be fulfilled by the visa applicant are:

  1. he/she must be more than over 18 years old.
  2. he/she is in a civil partnership or marriage that is recognized in the UK.
  • he/she has been living together in a relationship for at least 2 years with his/her British citizen spouse or common law spouse before applying for this visa.
  1. he/she has a fiancé, fiancée or proposed civil partner and will marry or enter into a civil partnership in the UK within 6 months of arriving in the UK or a combination thereof according to the law at the time of the filing of the application.
  2. he/she has a sound knowledge of English and this is shown by:
  • passing one of the recognized English language tests with a grade if at least CEFR Level A1 in the speaking and listening sections of the test, or
  • having a degree or academic qualifications that was taught or research that was conducted in the English language and if so, then have his/her qualification recognized by the UK NARIC as being equivalent to a UK Bachelor’s degree or higher.
  1. he/she can financially support himself/herself and his/her dependents This is the called the “minimum income requirement”. The visa applicant and his/her partner must have a combined GROSS income of at least 29,000 pounds per year or savings in the amount of 88,500 pounds which has been held in a bank account for the past 6 months.
  • he/she intends to live together with his/her British spouse permanently in the UK.

The requirements of the spouse of this visa are:

  1. he/she must be more than over 18 years old.
  2. he/she must be a British citizen.
  • he/she intends to live together with the visa applicant permanently in the UK.

If the visa applicant can’t meet the minimum income requirement, then the visa applicant may be able to settle in 10 years in certain instances.

 

The visa applicant may be able to settle in 5 years without meeting the minimum income requirement if either applying as a parent or if he/she receives certain benefits, for example Disability Living Allowance or a Carer’s Allowance.

If the visa applicant does not meet these requirements, he/she may still be able to apply for a visa or extend your permission to stay if:

  1. you have a child in the UK who is a British citizen or has lived in the UK for 7 years and it would be unreasonable for them to leave the UK.
  2. there would be very significant difficulties for you and your partner if you lived together as a couple outside the UK that could not be overcome.
  • it would breach your human rights to stop you coming to the UK or make you leave.

If the visa applicant is applying as a fiancé, fiancée or proposed civil partner, then he/she needs to prove that any previous marriages or civil partnerships have ended and that the visa applicant and his/her fiancé plan to marry or become civil partners within 6 months of arriving in the UK. The visa applicant will not be able to work during his/her engagement.

A marriage or civil partnership visa is granted for 2.5 years, or for 6 months if the visa applicant is applying as a fiancé, fiancée or proposed civil partner.
